These terms govern the use of 1PrimeCDN. By opening an account you accept them. They are written in plain language on purpose: if a part is not clear to you, ask before you sign.
1PrimeCDN is a service of Prime Server S.r.l., Via General Cantore 33-35, Grosseto (GR), Italy · VAT and tax code IT01794620532.
The service is a network of nodes that caches and serves your site's content, a managed DNS, HTTPS certificates and protection against abuse and application-layer attacks (1PrimeCDN Shield).
The account is yours and you are responsible for what happens under your credentials. Keep them safe and tell us at once if you think someone has taken them.
You must be at least 18, and if you open the account for a company, you must have the authority to bind it.
The details you give us for invoicing must be true and current.
The plans are the ones published in the pricing section. Prices are exclusive of VAT.
Invoicing is monthly and in advance. If you exceed the traffic included in your plan we tell you first: you move up a plan, no surprise adjustment lands on your invoice.
You can cancel at any time, effective at the end of the month you have paid for. We do not refund months already started.
The unlimited plan has a stated bandwidth ceiling of 200 Mbit/s per account, and is meant for websites, applications and online shops.
It is not suitable for, and may not be used for, video streaming, file archives, download mirrors or backups: those are the uses a flat rate cannot carry. If your traffic is mostly of that kind, talk to us: we will work something out rather than suspend you.
If you stay above the bandwidth ceiling we write to you and agree how to carry on. We do not switch a site off without warning, except where the usage is harming other customers.
Content unlawful under Italian or European law; material infringing someone else's copyright or trademarks; malware, phishing pages or pages built to imitate another organisation; sending unsolicited mail; any use that serves to attack third parties.
If we receive a substantiated report we write to you and, in serious cases or where the law requires it, act at once.
The network is made of nodes in several cities and from several providers: if a node goes down, the names stop pointing at it within about thirty seconds and traffic moves to the others. We commit to that with numbers, not good intentions.
The guaranteed levels, measured over each calendar month:
How it is measured. A zone counts as unavailable when, for five consecutive minutes, none of the nodes serving it answers a valid request for one of its hostnames, or when the nodes answer with an error of ours (a 5xx that does not come from your origin server): a node that answers «error» is not a node that works. Those minutes add up over the month. Our monitoring, which checks the nodes continuously, is the reference; if your own measurement says otherwise, send it to us and we look at it together.
The penalties. If we miss the guaranteed level we credit part of that month's fee. You do not have to claim it: we work it out when the month closes, it appears on your statement and goes back onto your credit.
You do not have to prove a loss and you do not have to write to us: the figure is ours and we apply the penalty ourselves. If more than one zone had an outage, the worst one counts, and the cap is still 100% of the month's fee. If you think the measurement is wrong you have thirty days from the end of the month to tell us, from the panel or the contact form, and we look at it together. If we stay below 99% for three months running you may cancel with immediate effect and we refund the current month.
What does not count. Scheduled maintenance announced at least 48 hours in advance, never more than two hours a month and carried out in quieter hours; periods when your own origin server is down or answering with errors; cases where your domain does not point at our names; use outside these terms; force majeure, including carrier network failures and orders from the authorities.
Attacks, on the other hand, do count: if your site is unreachable because it is under attack, as far as we are concerned that is an outage like any other. It is the reason this CDN exists.
Shield filters abuse and application-layer (layer 7) attacks on our own nodes. Volumetric network attacks are filtered by the infrastructure providers, and when you switch on «under attack» mode we serve your site only from the nodes that sit behind those filters.
What we cannot do is guarantee that no attack gets through: nobody can. We tell you honestly how far we go, and we tell you beforehand, not during.
We may suspend or close an account for non-payment after a reminder, for breach of these terms, or for usage that puts the network and other customers at risk.
If we close the account without a breach on your side, we refund the unused part of the month.
The service is provided with the care of a professional operator, but we cannot answer for indirect damages, lost profit or loss of data that does not depend on us.
In any case our total liability does not exceed what you paid for the service in the preceding twelve months.
Nothing in these terms excludes liability that the law does not allow to be excluded.
If we change these terms we tell customers by email thirty days in advance. If the change does not suit you, you may cancel within that period at no cost.
Italian law applies. For disputes with business customers the courts of Grosseto have jurisdiction; for consumers, the courts of their place of residence or domicile remain competent.
